01Accepting these terms
By using the Service you confirm that you can bind your organisation to these terms and that you accept them. If you don’t agree, don’t use the Service. Where you and we have signed a separate agreement, it takes precedence over these terms where the two conflict.
02What the Service does — and doesn’t
Capacity Plan turns forecasts, assumptions and team data into staffing requirements, coverage, and suggested fixes. Its results are planning estimates: they depend on the data and assumptions you enter and on the queueing model described on our website, including its stated limits.
The Service does not guarantee any service level, and decisions about staffing, hiring and scheduling remain yours.
03Accounts and workspaces
You sign in with one-time codes sent to your work email. You are responsible for keeping that mailbox secure and for activity in your workspace, and you’ll tell us promptly at the address below if you suspect unauthorised use.
04Your data
You keep all rights to the data you put into the Service. You give us a limited licence to host and process it only to provide the Service, as described in our privacy policy.
You confirm that you’re entitled to add the people and contracts you upload, and that your organisation has informed its staff as the law requires.
05Planifizer
If you connect a Planifizer workspace, data moves between it and your Capacity Plan workspace as you direct. Your use of Planifizer itself is governed by Planifizer’s terms.
06Early-access features
Features we label as early access — the Planifizer sync, for example — are offered so you can try them before they’re finished. They may change or be withdrawn, and they’re provided as they are.
07Acceptable use
You agree not to:
- use the Service in breach of any law or regulation;
- try to access data or systems you aren’t authorised to, or probe, scan or overload the Service;
- reverse engineer, resell or sublicense the Service without our written consent;
- upload content that is unlawful or infringes anyone’s rights.
08Plans and fees
Fees for paid plans are those in your order or the plan you choose, billed in advance for each period unless agreed otherwise. Fees are non-refundable except where the law requires. Changes to your plan take effect from the next billing period.
09Availability and support
We work to keep the Service available and fast, but we can’t promise uninterrupted access. We may carry out maintenance, and we’ll give notice of planned downtime where we reasonably can. Support is provided by email.
10Our intellectual property
The Service, its software and its design belong to DHAKAA. If you send us feedback or ideas, we may use them without obligation to you.
11Ending your use
You can stop using the Service at any time. We may suspend or end access if you materially breach these terms. When access ends, we’ll keep your data available for export for a limited period before deleting it, as described in our privacy policy.
12Disclaimers and liability
To the extent the law allows, the Service is provided without warranties beyond those in these terms, we are not liable for indirect or consequential losses, and our total liability is limited to the fees you paid us for the Service in the twelve months before the claim. Nothing in these terms limits liability that can’t be limited by law.
13Changes to these terms
We may update these terms. If a change is material we’ll give reasonable notice before it takes effect; using the Service after that means you accept the updated terms.
